Who is eligible to receive the official title of “political internee”?
In France the title of “political internee” refers to any person who was interned after June 16, 1940, due to the Nazi occupier or the French state, for motives other then acts of Resistance, with the exception of ordinary offences. The title of “political internee” (instituted by the law #48-1404, on September, 9, 1948 and the decree # 50-325, on March 1st, 1950) is accessible to French persons and foreign persons present in France at the time who:
• were interned from June 16, 1940 by the enemy or by the de facto authority claiming to be the government of the French state. A duration of 3 months is required, except in case of escape or disability caused by internment. The internment must have taken place on the metropolitan territory; however, certain camps in Algeria, Tunisia and Morocco are eligible.
• suffered before June 16, 1940 from an administrative or judiciary measure depriving them from their freedom and who were interned beyond the duration of their sentence by the enemy or by the de facto authority claiming to be the government of the French state, in consequence of the danger that the liberation of the aforementioned persons would have represented for the enemy, because of their prior activity.
• was interned in a children’s house of the U.G.I.F. (Union Générale des Israelites de France) or of the O.S.E. (Œuvre de Secours aux Enfants) for 3 months at least.
The internment should not be the consequence of a crime that is not covered by the ordinance of July 6, 1943, which removed the criminal nature of offences committed for the cause of Resistance.
What are the rights given by the title of “political internee”?
The title of “political internee” gives the right:• to a pension of civil victims of war under the conditions of the code of military pensions of invalidity and war victims (reversible but not transferable).
